  • $875,000.00 MEDICAL MALPRACTICE SETTLEMENT – 63-year-old warehouse manager underwent elective total knee replacement. During the surgery the popliteal artery was injured. The injury was not recognized during surgery. The first surgical attempt at repair failed requiring a second procedure. As a result of loss of blood flow to the lower leg, the patient suffered severe loss of muscle and skin tissue and permanent nerve damage. The patient’s injuries prevent him from returning to work. The case settled for $875,000.00. (The patient was limited by law to $250,000 for non-economic damages for pain and suffering.), 2015
  • $1,115,000.00 – KAISER ARBITRATION AWARD. JL, a 48-year-old hairstylist had a Lapidus Bunionectomy performed by a Podiatrist at Kaiser in Irvine. The surgery was negligently performed and the follow-up care was negligent. JL required reconstructive surgery to repair the damage caused by the Kaiser Podiatrist. JL has permanent pain in her foot and deformity of her big toe. The pain severely limits how much she can work. The Arbitrator awarded JL $764,565.00 for past and future economic damages and $250,000.00, the maximum allowed by law, for pain and suffering. He awarded her husband $100,000.00 for loss of consortium., 2014
  • $275,000.00 Settlement – The 46-year-old medical records clerk saw her primary care physician for shoulder pain. She gave her consent to a shoulder joint injection, instead the doctor administered a trigger point injection into her back, and in doing so he punctured her lung causing a pneumothorax and a hemothorax. The plaintiffs lost wages totaled approximately $14,745 and her out of pocket medical expenses totaled about $9,457.31. NOTE: noneconomic damages for pain and suffering were limited by law to $250,000.00., 2014
  • Orange County Medical Malpractice Settlement – $300,000.00. 52-year-old plaintiff suffered a dural tear during a cervical laminectomy. As a result she had severe disabling headaches until the tear was repaired about 15 months after the original surgery. She was unable to work after the original surgery. The settlement in this Los Angeles Superior Court action was paid by the hospital. The surgeon had fled the country after two similar results.   • $400,000.00 – Northern California Medical Malpractice Wrongful Death – The negligence of a Nurse Midwife in failing to promptly deliver a perfectly healthy term baby who got stuck in the birth canal, resulting in the baby’s death due to asphyxiation. This settlement was with the hospital that employed the nurse midwife. (Sadly this case was against the same hospital and involved the same nurse midwife as the case described above it. The death of this perfectly healthy baby occurred exactly the same as the one discussed above, just a year apart.), 2009

The injured child, now age 5, suffers from severe kidney damage, developmental delays and growth retardation because his mother was given Lotensin, a blood pressure medication during her pregnancy, and her obstetrician did not tell her to stop taking it or advise her of the risks of kidney damage to her unborn child if she continued to take it.
